Welcome to Naplesaway.com. This Website is maintained as a service to our customers. By using this site, you agree to comply with and be bound by the following terms and conditions of use. Please review these terms and conditions carefully. If you do not agree to these terms and conditions, you should not use this site.
1. Agreement. This Term of Use agreement ("the "Agreement") specifies the Terms and Conditions for access to and use of naplesaway.com (the "Website") and describe the terms and conditions applicable to your access and use of the Website. This Agreement may be modified at any time by the agents of Naples Away upon posting of the modified Agreement. Modifications shall be effective immediately. You can view the most recent version of these terms at any time at naplesaway.com. Each use by you shall constitute your unconditional acceptance of this Agreement.
2. Privacy. Your visit to our site is also governed by our Privacy Policy. Please review our Privacy Policy below
3. Ownership. All content included on this website is and shall continue to be the property of Naples Away or its content suppliers and is protected under applicable copyright, patent, trademark, and other proprietary rights. Any copying, redistribution, use or publication by you of any such content or any part of the Website is prohibited, except as expressly permitted in this Agreement. Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of this Website.
4. Intended Audience. This Website is intended for adults only. This Website is not intended for any children under the age of 18.
5. Intellectual Property. All site content is deemed to be the intellectual property of Naples Away or its affiliates.
6. Website Use. Naples Away grants you a limited, revocable, nonexclusive license to use this Website solely for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works, or other use. You agree not to copy materials on the Website, reverse engineer or break into the Website, or use materials, products or services in violation of any law. The use of this Website is at the discretion of Naples Away, which may terminate your use of this Website at any time.
7. Compliance with Laws. You agree to comply with all applicable laws regarding your use of the Website. You further agreed that information provided by you is truthful and accurate to the best of your knowledge.
8. Indemnification. You agree to indemnify, defend and hold Naples Away and its partners, employees, and affiliates, harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of this Website.
9. Disclaimer. The information on this Website is provided on an "as is," "as available" basis. Use of this Website is at your sole risk. Naples away disclaims all warranties, including but not limited express, statutory, and implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the extent your jurisdiction does not allow limitations on warranties, this limitation may not apply to you. Your sole and exclusive remedy relating to your use of this Website shall be to discontinue using it..
10. Limitation of Liability. Under no circumstances will Naples away be liable or responsible for any direct, indirect, incidental, consequential (including damages from loss of business, lost profits, litigation, or the like), special, exemplary, punitive, or other damages, under any legal theory, arising out of or in any way relating to the Website, your Website use, or the content, even if advised of the possibility of such damages. Your sole remedy for dissatisfaction with the Website and/or content is to cease all use of it.
You may have additional rights under certain laws (including consumer laws) which do not allow the exclusion of implied warranties, or the exclusion or limitation of certain damages. If these laws apply to you, exclusions or limitations in this Agreement that directly conflict with such laws may not apply.
11. Use of Information. Naplesaway.com reserves the right, and you authorize us, to use and assign all information regarding site uses by you and all information provided by you in any manner consistent with our Privacy Policy.
12. Copyrights and Copyright Agent. If you believe your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have otherwise been violated, please provide notice to us immediately.
13. Applicable Law. The laws of the State of Florida, without regard to conflicts of law provisions will govern these Terms and Condition of Use and any dispute that may arise from them.
14. Severability. If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.
15. Waiver. The failure of Naples Away to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. Any waiver of this Agreement by must be in writing and signed by an authorized representative of Naples Away.
16. Termination. Naples Away may terminate this Agreement at any time, with or without notice, for any reason.
17. Relationship of the Parties. Nothing contained in this Agreement or your use of the Website shall be construed to constitute either party as a partner, joint venture, employee or agent of the other party, nor shall either party hold itself out as such. Neither party has any right or authority to incur, assume or create, in writing or otherwise, any warranty, liability or other obligation of any kind, express or implied, in the name of or on behalf of the other party, it being intended by both parties that each shall remain independent contractors responsible for its own actions.
18. Entire Agreement. This Terms of Use constitutes the entire agreement between you and Naples Away and governs the terms and conditions of your use of the Website and supersedes all prior or contemporaneous communications and proposals. Notwithstanding the foregoing, you may also be subject to additional terms and conditions, posted policies (including but not limited to the Privacy Policy), guidelines, or rules that may apply when you use the Website. Naples Away may revise this Terms of Use at any time by updating this Agreement and posting it on the Website. Accordingly, you should visit the Website and review the Terms of Use periodically to determine if any changes have been made. Your continued use of this Website after any changes have been made to the Terms of Use signifies and confirms your acceptance of any such changes or amendments.

Thank you for using our Website. This statement discloses the privacy policy for naplesaway.com (the “Website”).
We have adopted this Privacy Policy to further the relationship between us and our subscribers. This statement of our Privacy Policy makes disclosures concerning our collection of information, including personal information, when you use the Website, and how we use and disclose it to others. We will use cookies to track your use of the Website and the services and products we offer and sell, provide you with a more personalized user experience and to facilitate your logging in to the Website. Therefore, while we strive to use commercially acceptable means to protect your personal information, we do not guarantee absolute security. We are not responsible for the unauthorized acts of others and we assume no liability for any disclosure of information due to errors in transmission, unauthorized third party access (such as through hacking) or other acts of third parties, or acts or omissions beyond our reasonable control.
Reviewing and Changing Your Personal Information. You may obtain a copy of and request that we correct errors in your personal information by emailing us. If you do desire to obtain a copy of your personal information, you will be required to provide proof of your identity. If your personal information changes or if you no longer want to subscribe to or use the Website, you may correct, update or deactivate your personal information and your account through the account management screen. If you wish to deactivate or terminate your subscription you may also contact Customer Service.
Application of Privacy Policy You Access Third Party Websites. You will be able to access third party websites directly from the Website. This Privacy Policy does not apply when you access third party websites. We cannot control how third parties may use personal information you disclose to them, so you should carefully review the privacy policy of any third-party website you visit before using it or disclosing your personal information to its provider.
Children’s Privacy. . It is unlikely that children under the age of 18 will use the Website or purchase the services or products we offer. Accordingly, we will not knowingly collect or use any personal information from children that we know to be under the age of 17. In addition, we will delete any information in our database that we know originates from a child under the age of 18.
Opting-Out from Receiving Communications from NaplesAwaycom. You may opt-out from having your personal information used for certain purposes. For example, if you purchase a product or service but do not wish to receive any additional marketing material from us, you may indicate your preference on our order form. If you no longer wish to receive any promotional or other communications from us, you may opt-out by following the instructions included in each email communication or by emailing us.
Changes in Privacy Policy. This Privacy Policy is subject to change from time to time. We will notify you by email or on our Website whenever there is a change in our Privacy Policy.

RENTAL TERMS

NAPLES AWAY operates under license number CND2102807, Hotels and Restaurant Division of the State of Florida and is a wholly owned subsidiary of STEWART REAL ESTATE COMPANY LLC. Your reservation is subject to the completion of our standard lease and will often require the registration of your tenancy by the property's Community Association. This is typically a routine process, using boilerplate documents, but is often necessary for the caliber of the homes and communities in which you will be staying. 

Reserving on-line puts your property ON HOLD. We will contact you to confirm availability and any minimum nights stay. Once confirmed, we will send paperwork for signature and charge your deposit to secure your booking.

Some of our homes are in communities requiring a 30 day minimum tenancy. Some owners also prefer a single 60 - 90 day booking in Peak Season. We will work closely with you to match your needs with any specific property guidelines. It is always helpful if your booking dates line up with the beginning and end of a Calendar month.

In addition to your separate agreement to the terms of the lease and any specific community regulations, by "Submitting" the reservation form, you are confirming that you have read and agreed to the rules and regulations listed below. Your ON HOLD reservation is subject to confirmation, receipt of payment and the understanding that you will adhere to the terms herein from Naples Away. The balance is due 60 days prior to the arrival date and it is the Guest’s responsibility to make sure payment arrives on time. If the balance remains unpaid at 50 days, we reserve the right to cancel your reservation and put the unit back on the market. (See Cancellations & Substitutions below). Reservations closer than 60 days must be paid in full when the booking is made.

To make this reservation, you must be at least Thirty Five Years old (35 yrs.) and occupy the unit for the entire time of the reservation. We do not rent to groups of singles under 35 or teens with chaperones . The maximum occupancy, of people over the age of Three years old (3 yrs.) is listed on the website for each unit and is strictly enforced. We reserve the right to determine the number of children that may accompany a parent or guardian. Guest may not assign or transfer this agreement. Outside guests are not permitted on a regular daily basis without approval. Community management will ask you to leave if you are under age or if there is evidence of outside, non-registered guests. Please do not leave children under 14 alone in the unit.

Cancellations & Substitutions: Subject to any negotiated provisions, any change or cancellation of a confirmed reservation prior to original scheduled arrival will be subject to the loss of deposit and any further payments as specified in the lease. If the house is re-rented, you will receive a refund equal to the amount the house was re-rented for, minus a Three Hundred Fifty dollar ($350.00) service charge which may be applied to a future reservation. 

Travel Insurance: Please note that Generali/CSA Travel Insurance is available for United States residents only. Coverage Questions? Call (866) 999-4018. We are pleased to offer the option of CSA Travel Insurance which covers trip cancellation, trip delay / interruption, rental car collision, baggage delay, medical expense / emergency medical transportation, roadside assistance, concierge service, identity theft and more. The cost is a very reasonable at approximately 9% of your total booking and covers everyone on your guest list. We strongly recommend you purchase this valuable protection, which will reimburse you for pre-paid, non-refundable expenses due to certain unforeseeable circumstances. However, if you do not wish to purchase travel insurance, please select “No” to Travel Insurance when booking. If you are traveling between June 1 and November 31 (Hurricane Season) or when there is a possibility of trip delay due to snow, insurance is highly recommended. There will be no refund or credit for any reason other than those covered in “Cancellations & Substitutions”.

Property: All units are privately owned. The owner and Naples Away shall be held harmless from all claims or causes of actions arising from the rental of the unit by the guest. The owner and Naples Away are not responsible for any of the guest’s items lost or stolen.

Check In/Check Out: Check-in time is after 3:00 p.m. Please notify everyone in your party. If arriving after 6 pm or a day or two late, please notify our office. Check-out time is by 10:00 am. Please be on time as our housekeepers need time to get the property ready for the next guest. If you are leaving early, please notify our office. Kindly..

  • Place all dirty dishes in the dishwasher and turn it on.
  • Return all furniture to original locations and leave remote controls in plain sight
  • Please leave used towels in the laundry room but do not strip the beds. We have a professional laundry service for the houses.
  • Tidy up any pool/deck area and make sure toys, coolers etc. are put away. Clean BBQ with a brush.
  • Bag up all garbage and take to the cans. Please recycle as much as possible: cardboard, paper, glass, plastic & aluminum all go in the re-cycle container
  • Please insure that there is no excessive cleaning required due to your visit. Empty the fridge and wipe down shelves. Cleaning staff will gratefully enjoy any unopened produce, condiments, dairy or meat you leave behind
  • Please double check that you have all of your belongings, especially check outlets for phone and camera chargers. There is a charge to return items left behind.
  • Please turn off all fans and lights. Set air conditioning to 78 degrees.
  • Lock all doors and windows, check them and leave keys and remotes according to prior instructions.

    PLEASE LEAVE A NOTE IF ANY REPAIRS ARE REQUIRED AT THE END OF YOUR STAY

Security Deposit Protection (SDP): As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $3000. Any damages that exceed $3000 or are not covered under the plan will be charged to the guest. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3000. Certain terms and conditions apply. Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage or Insurance Policy on the naplesaway.com website. The Vacation Rental Damage plan can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request CSA Travel Protection and Insurance Services to pay directly Naples Away any amount payable under the terms and conditions of the Vacation Rental Damage. Please contact Naples Away directly if you do not wish to participate in this assignment. If you do not wish to purchase the Vacation Rental Damage Protection, a $1500- $3000 damage deposit will be required upon check-in, depending on the property in question.

Pets: Dogs are only permitted in a handful of units so please inquire when booking. Cats are not permitted except by written permission in a very few homes. There is a non-refundable pet fee of Two Hundred Dollars ($200.00). The pet fee does not cover removing pet waste so please stoop & scoop. Pets are not allowed in the pool. You must keep your pet leashed and under control at all times. If any evidence of a pet(s) is found in your unit or on the premises without prior written permission, you will be asked to vacate immediately with no refund of any payments. The owner of the house and Naples Away ! shall be held harmless from all claims or causes of actions arising from, but not limited to damage or physical injury, caused by the pet. You are responsible to have your pet up to date on all shots and vaccinations including but not limited to tick and flea treatment. Please do not leave pets home alone if you are expecting a service technician as they will not enter the premises.

Smoking: Smoking is not permitted in any unit. If there is evidence of smoking in the house, you will be charged Two Hundred Fifty dollars ($250.00) plus the cost to remove all evidence of smoking. (This typically involves dry-cleaning of window treatments and bedspreads, shampooing the upholstery and carpets, and changing the air filters.) Please smoke outside and clean up all evidence of smoking.

Vehicles: It is understood that RV’s, boats, motor homes, trucks, motorcycles, trailers etc. are not permitted . It is also understood that, at no time, are vehicles allowed to be used for accommodation or connected in any way to utilities of the main home. All houses have limits for the number of parking spaces which are strictly enforced. Please refer to the property listing for details.

Keys & Remote Controls: Two keys, or keypad access, will be provided, plus garage and front gate clickers. Lost keys will be charged at the rate of Seventy-five dollars ($75.00) per lock to cover the cost of re-keying. There will be a charge of $65 for each lost remote control.

Utilities, Services & Amenities: A few of our houses have free long distance in the USA and Canada only. All other long distance calls should be made on your cell phone, calling card or on a pre-paid phone card. Calls or services not billed to your own payment method will be charged to your account.In the event of any equipment malfunction, please call Naples Away , who will arrange to have the repair expedited as quickly as possible. However, no rent refund will be paid for any nonperformance of appliances or equipment, including pool or internet equipment. Maid service is not included. If you would like additional cleaning services, this can be arranged, at your own expense.

Swimming Pool and Pool Area: In homes with pools, the pool is typically heated by an electric heat pump and some pools are also augmented with solar heat. There will be instructions for regulating the pool temperature in the home. In the winter months, if the air is cold, the water temperature might not reach the set temperature and will be very costly to heat. For this reason, each pool home has a (generous) cap on the heating utility bill to be paid by the owner. Any indiscriminate use of the pool heater or air conditioning will result in an additional charge to the tenant, over the agreed utility cap. It is recommended that a solar blanket be used (if present) when the evening temperatures drop below 70 deg. There is no guarantee as to the pool suitability or temperature. Use of the Swimming Pool is "at your own risk". All guests assume the risks of use and waive the right to file suit against the owner and / or Naples Away for any loss, damage, injury or liability that should occur. A Pool Waiver form is provided for this purpose. PLEASE AVOID DIVING. The guest assumes all responsibility for themselves and anyone that they allow to be in the pool area; there is no lifeguard on duty.

  • An adult ABSOLUTELY MUST supervise children at all times. The tragedy of child drowning occurs every year in Florida and is a nightmare we all must work to avoid. Pools are gated, caged or alarmed but you, as the parent or guardian, play a critical role – on vacation, just as at home.
  • Only registered guests are allowed.
  • Pets are forbidden in the pool and pool area.
  • No glass or breakable objects.
  • Area must be kept in a clean and proper order.
  • Please do not throw anything heavier than a pool noodle in the screened pool area as the screens tend to get damaged. This is considered “Willful” damage and is NOT covered by your damage insurance.
  • Please insure that young children wear swim diapers and not regular diapers.

The pool is serviced regularly and has automatic cleaning and chlorinating systems. Please notify Naples Away immediately if there are any problems or concerns; unfortunately, there will be no rent refund if the pool or spa is closed due to any circumstance. The gates and pool cage doors are to be kept closed and secured at all times.

Bicycles, Lounge Chairs and Towels: If you take any house property out of the home, please make sure it is all returned to the house each night. Replacement cost is Seventy Five Dollars ($75.00) per lounge chair and Twenty Five dollars ($25.00) per towel. Bicycles will be replaced at accurate replacement cost.

Quiet times: Naples Away  takes the enjoyment of our guests very seriously. Quiet times between 10:00 p.m. (2200 hrs.) and 7:00 a.m. (0700 hrs.) are mandated and must be respected. Please remember that noise carries very well close to water and that conversations are easily heard from balconies and pools. Should continued, excessive noise persist, please be advised that the Sheriff will be called and your tenancy may be terminated immediately and you may be billed for any damages. Your cooperation in helping us maintain friendly relations with the neighbors, and the Community, is greatly appreciated.

Amenities: The property is fully furnished, and includes ready-made beds, 1 set of bath towels per guest and an equipped kitchen. Furnishings and amenities are not new and may exhibit signs of wear and tear. Amenities and furnishings are subject to change, and may or may not be the exact same as represented due to replacement, substitution or other reasons. Manager provides a starter kit of soaps, dish detergent, laundry soap, shampoo, toilet paper, paper towels, and other dispensable items. Since a limited supply is provided, Guest should plan to shop to replenish these items if necessary. Manager assumes no responsibility for the quality or contents of any food products left on the premises and Guests use and/or consumption of same is not recommended and shall be at Guest's own risk(s). Towels (except beach towels) and linens are not to be taken from the units.

Guest Notification Responsibilities: Upon arrival, Guest agrees to examine the Unit, all furniture, furnishings, appliances, fixtures and landscaping, if any, and shall immediately report to Manager if any are not in operating condition or in disrepair. Guest also agrees to immediately notify Manager of any occurrences that may cause damage to Property or adjacent units and to take reasonable measures to mitigate damage, and be responsible for damages for failure to do so. Guest acknowledges that unless Manager is notified on day of check-in of any damage or cleaning concerns, Guest will be liable. Any and all damages, breakage, lost or missing items on the Property during the occupancy will be Guest's responsibility and must be reported to Manager and paid prior to departure.

Subleasing: Guest shall not sublet the property.

Owner's Property: Guest agrees not to access the owner's storage area, even if unlocked, which contains owners personal property and may contain cleaning supplies and chemicals that could be hazardous to children and adults.

Lost Items: Manager shall bear no responsibility for lost, stolen or abandoned items. Every reasonable effort will be made to contact the Guest for return. There will be a minimum $25.00 handling charge plus shipping costs for any found items returned at Guest's request. Manager shall not be held liable for condition of said items. Any items not claimed for longer than 30 days may be donated or sold.

TV/Cable/Internet/Satellite: Services are provided as a convenience only, and are not integral to this agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to service.

Air Conditioning/Heating: Guest agrees that Air conditioning shall not be set below 72 degrees and heat shall not be set above 78, and that the fan setting shall be "Auto". Doors and windows shall be closed when either heat or air conditioning is in operation. There are no refunds for lack of, or malfunctioning HVAC units.

Pool and Spa: Pool heat shall not exceed 84 degrees. Guest understands that the area surrounding pool and spa may not be fenced or secure. Guest also understands and agrees to be responsible and liable and will pay Manager upon request for any damages that occur to the pool and spa and its support equipment through misuse and/or negligence.

Amenity Failure: In the event the rental unit sustains a failure of a system, including but not limited to water, sewer, septic, electrical, gas, plumbing, mechanical, appliances, heat pump, ventilating, pool, hot tub or other system or structural systems, furnishings or amenities, Manager will make every reasonable effort to repair or replace the failed system or equipment, and in such event, Guest agrees to permit Manager or its service provider to have reasonable access to the property to inspect and make such repairs. Neither the property owner nor the Manager shall be liable to Guest for damages, and no refunds will be given for such failures.

Other Occurrences: Manager does not accept liability for any loss or damage caused by but not limited to the following: weather conditions, natural disasters, pests, construction disturbances, acts of God, or other reasons beyond its control. There shall be no refunds of rents because of shortened stays, ruined expectations, or departures due to work and family emergencies, unavailability of any or all parts of the Unit, or any other reasons. It is highly recommended that Guest considers the purchase of travel insurance

Reservations are not fully guaranteed: If for any reason, the Property is not available or becomes unavailable or uninhabitable for the reservation dates, every effort will be made to locate substitute accommodations. If the substituted property rents for more for the same period, or remaining period respectively, Guest will have the option to pay any additional charges or cancel the reservation within 72 hours of notification of Guest by Manager. However, if the substitute property rents for less for the same period, the difference will be refunded to Guest. In any event, the sole remedy for any perceived damages, liability, or inconvenience is a full refund of the rental amount upon Guest cancellation. It is highly recommended that Guest considers the purchase of travel insurance. 

Agency: It is mutually understood and agreed that Manager is acting as Agent only for the property owner and has no liability to either party for the performance of any terms or covenant of this agreement. Furthermore, Guest understands Manager is being compensated in this transaction by the property owner and is contractually obligated to protect the interest of same. Manager hereby discloses to Guest that should Guest elect to purchase travel insurance protection or damage insurance through Manager, Manager may be compensated by provider(s) for cooperation in the transaction.

Hold Harmless: The Guest and all occupants shall hereby indemnify and hold harmless the Manager and property owner against any and all claims of personal injury, property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Guests also expressly recognize that any insurance for property damage or loss which the Landlord may maintain on the property does not cover the personal property of Guests, and that Guests should purchase their own insurance if such coverage is desired. 

Additional terms and Conditions: The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Manager and Owner from any and all claims, demands and causes of action by reason of any injury or whatever nature which may have occurred to the undersigned, or any of his/her occupants or guests as a result of, or in connection with the occupancy of the premises and agrees to hold Manager and Owner free and harmless of any claim or suit arising there from. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs.

Electronic Consent: By checking the box and clicking on the "I AGREE" button, Guest is consenting to the use of an electronic signature in lieu of an original signature on paper. Guest has the right to request to sign a paper copy instead. By checking the I AGREE button, Guest waives that right. After consent, Guest may, upon written request to Manager, obtain a paper copy of the electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Guests agreement to use an electronic signature for any documents will continue until such time as Guest notifies Manager in writing that you Guest longer wishes to use an electronic signature. There is no penalty for Guest withdrawing this consent. Guest should always ensure that Manager has a current email address on file in order to contact Guest regarding any changes, if necessary.

Naples Away ! is not responsible for any inadvertent errors or omissions or for recent changes by an owner to their property. Policies, descriptions, conditions, rates and amenities listed are subject to change without notice.The laws of Florida govern this Agreement and it may not be changed orally, only in writing. It should be viewed in conjunction with the terms agreed in the associated property lease and any applicable Community Rules and Regulations.
